Also known as: common fund, MDL common benefit assessment, plaintiffs' common benefit fund
A court-ordered or negotiated fund established in mass tort and MDL proceedings to compensate attorneys who perform work benefiting all plaintiffs in the litigation, not just their own clients. Contributions are typically assessed as a percentage of individual plaintiff recoveries and are drawn from attorney fees rather than client settlements. The fund reimburses lead and liaison counsel for shared litigation costs such as expert witnesses, document review, and bellwether trial preparation that advance the collective case.
